Where the CPAP case stands
Philips recalled CPAP and BiPAP machines, and users sued. Their federal cases went to MDL 3014 in the Western District of Pennsylvania, before Senior Judge Joy Flowers Conti. In total, 1,033 cases were filed there. On October 1, 2026, 623 were still pending.
The case resolved through three separate settlements. Each covered a different kind of claim.

The three settlements
Economic loss. The parties reached this class settlement on September 7, 2023. Philips recorded a provision of EUR 575 million for it. Seeger Weiss, one of the co-lead firms, says the court granted final approval on April 25, 2024. The firm describes the deal as worth more than $500 million, with no cap. That description comes from the firm’s own page. The claims period closed on August 9, 2024. Philips says the administrator is still processing claims and paying eligible class members.
Personal injury. This deal was not a class settlement. Each injured person had to register. Of the $1.075 billion total, $25 million went to notice and administration. The other $1.050 billion funded a Personal Injury Settlement Fund. The deal needed at least 95% of eligible claimants to register. Registrations passed that mark, and the deal became final at the January 31, 2025 deadline. Philips paid in the first half of 2025.
Medical monitoring. This class settlement is capped at $25 million. It became final in January 2025.
Who is still in the case
The 623 pending cases include people who declined the settlement and people found ineligible for it. Philips says these plaintiffs must identify themselves and meet court-ordered discovery duties. One duty is early disclosure of causation evidence. In plain terms, they must show early on that the device caused their injury.
The court has enforced those duties:
- April 2, 2026. The court ordered 48 “Litigating Plaintiffs” who were ineligible for the settlement to fix problems under its Docket Management Order by April 23, 2026, or face dismissal.
- June 26, 2026. The court dismissed the claims of the listed plaintiffs who did not comply. The dismissal was with prejudice, so those claims cannot be refiled.
An April 2026 scheduling order reportedly sets deadlines on general causation and on whether the court has jurisdiction over Koninklijke Philips N.V., the parent company. We saw this only in a search summary and have not read the order. We will confirm it before relying on it.
No trial date appears in the records we reviewed.
What it means if you never filed
Each settlement had its own deadline. Here is where each path stands.
| Your situation |
What it means now |
| You had a financial loss from a recalled device |
The economic-loss claims period closed August 9, 2024. |
| You had an injury and wanted to join the injury settlement |
Registration closed January 31, 2025, and the fund has paid out. |
| You were a class member in the economic-loss or monitoring class |
Under federal class action rules, a damages class judgment binds members who got notice and did not opt out. Ask a lawyer whether that applies to you. |
A new injury claim would sit outside the settlements. It would face the same discovery rules the court is now enforcing, including early proof of causation. The court has already dismissed plaintiffs who missed those deadlines.
Time limits also matter. Personal injury deadlines differ by state. California and Texas allow 2 years. New York allows 3 years, and in some exposure cases the clock starts when the injury is discovered. Tennessee allows 1 year. Talk to a lawyer about your state’s deadline before deciding anything.
Philips and the FDA
Philips Respironics operates under a consent decree with the U.S. Department of Justice and the FDA. Under it, the company will not sell new CPAP or BiPAP devices in the U.S. until it meets the decree’s requirements. Philips reports that more than 99% of registered recalled devices had been remediated worldwide as of December 2025.
Plaintiffs’ leadership in MDL 3014
A March 24, 2022 court order named four plaintiffs’ co-lead counsel: Christopher Seeger, Sandra Duggan, Kelly K. Iverson and Steven A. Schwartz. The Plaintiffs’ Steering Committee includes lawyers from Levin Papantonio, Morgan & Morgan and Lieff Cabraser. Johnson Becker serves as Vice Chair of the Settlement Committee.

Reader questions
Can I still get money from the Philips CPAP settlement?
Probably not through the settlements themselves. The economic-loss claims period closed on August 9, 2024, and personal-injury registration closed on January 31, 2025. The claims administrator is still processing and paying eligible economic-loss claims that were filed on time. A lawyer can look at the facts of your case.
How much did the Philips CPAP settlement pay per person?
Philips has not published per-person amounts. The $1.075 billion figure is the total, including $25 million for notice and administration. Individual payments depend on each claimant's facts. Prior results do not guarantee a similar outcome.
Is the Philips CPAP lawsuit still open?
Yes, in part. MDL 3014 had 623 pending cases on October 1, 2026. These include people who opted out of the settlement or did not qualify for it. They must meet court-ordered discovery deadlines, and some have already been dismissed.
Can Philips sell new CPAP machines in the U.S.?
Not yet. Under a consent decree with the DOJ and FDA, Philips Respironics will not sell new CPAP or BiPAP devices in the U.S. until it meets the decree's requirements. Philips says more than 99% of registered recalled devices had been remediated worldwide as of December 2025.
What happened to plaintiffs who did not settle?
They had to identify themselves and produce evidence early, including causation evidence. On April 2, 2026, the court ordered 48 such plaintiffs to fix deficiencies by April 23, 2026. On June 26, 2026, it dismissed the claims of plaintiffs who did not comply, with prejudice.
